These Terms and Conditions (“Terms”) govern your access to and use of homesmartsavings.com (the “Site”), operated by Home Smart Savings (“we,” “us,” or “our”). By accessing the Site or submitting information through it, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Site.

Nature of our service. Home Smart Savings is an advertising and lead-referral service. We are not a contractor, installer, lender, insurer, or government agency, and we are not affiliated with or endorsed by any government program. We do not perform gutter installation, replacement, or repair. We do not guarantee that you will qualify for any offer, that any provider will contact you, or that any particular price, discount, rebate, or outcome will be available to you.

1. Eligibility

You must be at least 18 years old and a legal resident of the United States to use the Site. By using the Site, you represent that you meet these requirements and that all information you submit is truthful, accurate, and your own. Eligibility criteria displayed on the Site are illustrative only and do not constitute a promise of qualification, service, or savings.

2. Advertising and Compensation Disclosure

The Site is an advertisement. Content on the Site, including advertorial-style copy, testimonials, and comparison imagery, is presented for marketing purposes. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY INFORMATION ON THE SITE IS ACCURATE, COMPLETE, OR CURRENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER HOME SMART SAVINGS NOR ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR PARTNERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR PROPERTY DAMAGE, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR YOUR DEALINGS WITH ANY THIRD-PARTY PROVIDER, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

10. Indemnification

You agree to indemnify, defend, and hold harmless Home Smart Savings and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or connected with your use of the Site, your breach of these Terms, or your interactions with any third-party provider.

11. Governing Law and Dispute Resolution

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Site. Our failure to enforce any provision is not a waiver of it.
